SENATE CONCURRENT RESOLUTION NO. 87

Requesting the Joint Committee on Government and Finance study the
procurement and placement on insurance coverage on public
buildings and other public properties in the State of West
Virginia under the control of the state's 55 county
commissions.
Whereas, On August 8, 2006, a fire destroyed the Morgan County
Courthouse Complex in Berkeley Springs; and
Whereas, The proceeds from the insurance coverage in effect at
the time of the fire are not sufficient to cover the costs of
construction of the new courthouse complex; and
Whereas, Morgan County will require financial assistance in
the approximate amount of $8 million from the state to construct
the new courthouse complex; and
Whereas, This situation has given rise to significant public
policy questions regarding the procurement and placement of
insurance coverage on public buildings and other public properties
under the control of county commissions; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby
requested to study the procurement and placement on insurance
coverage on public buildings and other public properties in the State of West Virginia under the control of the state's 55 county
commissions; and, be it
Further Resolved, That representatives of the Board of Risk
and Insurance Management, West Virginia Association of County
Commissioners, West Virginia Association of Counties, West Virginia
Assessors Association and Professional Independent Insurance Agents
of West Virginia, Inc., be invited to serve on the interim study
commission; and, be it
Further Resolved, That the Joint Committee on Government and
Finance report to the regular session of the Legislature, 2008, on
its findings, conclusions and recommendations, together with drafts
of any legislation necessary to effectuate its recommendations;
and, be it
Further Resolved, That the expenses necessary to conduct this
study, to prepare a report and to draft necessary legislation be
paid from legislative appropriations to the Joint Committee on
Government and Finance.
